These Terms of Service ("Terms") are a legal agreement between you and Rhumbline Maritime LLC ("Rhumbline Maritime," "we," "us," or "our") governing your access to and use of MySailingPlan and our related website and services (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. Rhumbline Maritime is operated in, and intended for users located in, the United States.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
2. The Service
MySailingPlan provides sailing weather, tide, current, and conditions information, including boat-specific planning tools and forecasts for paid subscribers. We may add, change, or remove features at any time. Some features are available only on a paid plan. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
3. Advisory Information — No Reliance for Safety
The Service provides advisory information only. Forecasts, sailability scores, depth and tide windows, routing suggestions, and all other outputs are estimates based on third-party data and modeling, and may be inaccurate, incomplete, or out of date.
The Service is not a substitute for official navigational charts, official forecasts from the National Weather Service, NOAA, or the U.S. Coast Guard, a licensed captain's judgment, or your own prudent seamanship. You are solely responsible for the safety of your vessel, crew, and passengers. Always verify conditions through official sources before departure, and never rely on the Service as your sole source of weather, navigation, or safety information.
4. Subscriptions, Billing, and Cancellation
- Billing — paid subscriptions are billed in advance on a recurring basis (monthly or annual, as selected) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the applicable fees, including applicable taxes.
- Renewal — subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Cancellation — you may cancel at any time through the customer billing portal or by contacting us. Cancellation stops future renewals; you retain access for the remainder of the period you have already paid for.
- Refunds — except where required by law, fees are non-refundable.
- Price changes — we may change our fees; we will give you reasonable advance notice, and changes apply to billing periods after the notice.
5. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation;
- Access the Service through unauthorized means, or attempt to disrupt, overload, or compromise the Service or its infrastructure;
- Scrape, harvest, or systematically extract data from the Service except as expressly permitted;
- Reverse engineer, copy, or create derivative works from the Service except as permitted by law;
- Share, resell, or provide access to your account or paid features to others without authorization; or
- Use the Service to infringe the rights of others or to transmit malicious or harmful content.
6. Intellectual Property
The Service, including its software, design, text, and branding, is owned by Rhumbline Maritime LLC and protected by intellectual property laws. MySailingPlan is a trademark of Rhumbline Maritime LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial sailing use, subject to these Terms. You retain ownership of the boat, trip, and other content you submit, and you grant us a license to use that content as necessary to operate and provide the Service to you.
7. Third-Party Services and Data
The Service incorporates data and services from third parties, including weather, tide, and current data from the National Oceanic and Atmospheric Administration (NOAA) and the National Weather Service, authentication through Google, and payment processing through Stripe. We are not responsible for the accuracy, availability, or practices of third-party data or services, and your use of them may be subject to their own terms.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY INFORMATION IT PROVIDES IS ACCURATE, COMPLETE, RELIABLE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHUMBLINE MARITIME LLC AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY, OR FOR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold harmless Rhumbline Maritime LLC and its owners and operators from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, including if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
12. Governing Law
These Terms are governed by the laws of the United States and the State of Maryland, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland, except where prohibited by applicable law.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice as appropriate. Your continued use of the Service after an update means you accept the revised Terms.
